Platform Regulations: eNetes.com - New Technology of the XXIIth Century

I. General provisions

§ 1

These Terms of Use define the rules of use of the internet services owned by Robert Brzoza - Brzoza Group.

The terms used in the present Terms of Use shall mean:

1.Registration Form - a survey that is completed by the user during the registration process on the Platform or website where the form for data entry is located.
2.Password - a string of user-defined or generated by the Platform for the password recovery process.
3.User Name (Login) - A unique User ID defined by the User during the registration process.
4.Login - confirming the User's identity registered by entering a username and password.
5.Robert Brzoza-Brzoza Group - owner of eNetes.com.
6.Platforms - a virtual platform available via the Internet at https://system.enetes.com, which allows the Promoters / Suppliers to offer free and paid Products.
7.User - a person using the Platform.

8.User Profile - A standard set of User Data that has been provided by the user during the registration process.
9.Training Company / Counterparty - a company providing its own courses, training, ebooks, services, physical products on the https://systemeNetes.com platform under a separate agreement with Robert Brzoza - the Bundled 10.Group, paid according to the price list.
11.Organizer / Contractor / Robert Brzoza-Birch Group/training company organizing the course and thus taking legal and financial responsibility for the proper service of its participants.
12.Trainer - the private person running courses or making their own courses on the https://systemeNetes.com platform under a separate agreement with Robert Brzoza-Birch Group.
13.Course / Product / Service - product offered at https://system.enetes.com - either physical (DVD, CD, book, other products), digital (online course, e-book, etc.), service or other.
14.Payment System - an external entity authorized to receive and process payments on behalf of the Organizer, from which the Platform is integrated and where the Organizer has an account to accept payments. In particular: PayPal.com (payment cards).

II. Using Platform

§ 3

Platforms are available for every Internet user, with access to specific courses/services available for free. The free courses are free of charge but may require a password.
By accessing the Platform, you acknowledge and agree to the terms and conditions of this Agreement.
Placing an order for a Paid Product DOES NOT oblige the User to pay it. The availability of paid courses is no faster than when payment is made in the payment system account. The Organizer accepts payments only through its own account in the Payments System integrated with the Platform. The user chooses the form of payment from the options provided by the Organizer.
Please note that all claims and comments regarding the quality of the courses should be directed to the Organizers.
Certain areas of the Platform may use cookies, which are small text files sent to the user's computer to identify him or her in a way that is necessary to simplify or rewrite the operation. Cookies are harmless to the computer, its user its data.

1.The condition of cookies is that they are accepted by the browser and not removed from the disk. You can also disable their activity in your browser settings, which may limit or prevent you from using certain parts of the Platform.

2.Cookies are used for statistical purposes, for site authorization, to customize the look of your site to your preferences and browsing history, and for other marketing purposes.

3.Cookies may contain your personal information, although in most cases this will only be your e-mail address. These data are available only for the user of the computer and for the platform.

§ 4

Use of platform resources (especially paid courses) requires a login.

Submission and payment of orders are not required.

1. III. Registration in the Platform

   § 5

   User Registration includes:

   Acceptance of Terms and Conditions,

   Correct filling of the Registration Form,

   Confirmation of registration by opening a special link sent by the platform after registration in the web browser after registering.

   The user gets full access to the Platform (excluding paid courses for which he has not paid) after properly confirming the registration process and logging into the Platform.
   Registered User may at any time modify his / her data contained in My Account.

   § 6

By submitting the Registration Form, the User confirms the authenticity and compliance with the facts contained in it and agrees to the provisions of these Regulations, recognizing its binding nature.

§ 7

Robert Brzoza-Brzoza Group reserves the right to refuse to register you.
Robert Brzoza-Birch Group reserves the right to block a User account that violates the provisions of these Terms and Conditions. In this case, the user is not entitled to compensation for lack of access to paid courses. Account unlocking may take place after a written statement of compliance.
In the event of a repeat of violation of the Terms and Conditions, despite the written statement, it will not be possible to unlock the account and the User will not have the right to claim compensation for the lack of access to the courses.
Refusing to register or to block a user account will result in the user's access to the Platform being blocked.
§ 8

Robert Brzoza-Birch Group undertakes to use the data provided by the User in accordance with the Personal Data Protection Act and the laws amending that law solely for the purpose of being made available and not disclosed to third parties unless otherwise provided by the applicable laws.
Exception from paragraph 1 is the right of Robert Brzoza-Birch Group to process User Data for marketing purposes including sending commercial information to an email address, mobile number or home address of the user.
Notwithstanding the foregoing, the User hereby agrees that Robert Brzoza-Birch Group may make available the above-mentioned information to those who cooperate with Robert Brzoza-Birch Group in order to provide the services properly. These entities shall apply mutatis mutandis to paragraph 1.
When placing an order for a paid product or signing up for a free product, the User authorizes the transfer of his / her personal data to the Organizer and the Trainer of the Product for the purposes of paragraphs 1 and 2.
Robert Brzoza-Birch Group is not responsible for the processing of personal data by a contractor or eNetes Trainer who is not simultaneously Robert Brzoza-Birch Group.

§ 9

The user has the right to deregister from the platform user base by sending an email to office@enetes.com or to the email address of the contractor:

"Please remove me from the system.eNetes.com user base." By sending this decision, I am aware that I will not be able to receive my login again, and deleting me from the database is irreversible and will result in lost access to paid courses. "

IV. User Obligations

§ 10

By using the Platform, the User is obliged to observe the provisions of these Regulations, which are generally binding. By using the Platform, the User is obliged to comply with the provisions of these Regulations, the generally binding provisions of Polish law and the habits adopted in connection with the use of the Internet.
Violation of these Terms and Conditions is considered in particular the publication of offensive and obscene materials and online practices generally accepted as defamatory.
Any action contrary to these regulations will give the user the responsibility and obligation to remedy the resulting damage on a general basis.
§ 11

You acknowledge that all information relevant to the operation of the Platform will be available on the Platforms and will be deemed to be properly delivered to you.
The user should inform the contractor / Robert Brzoza-Birch Group about changes in the data submitted during registration.

V. Legal disclaimer

§ 12

Robert Brzoza-Birch Group is not liable for any damages incurred in connection with the use of information presented under the Platform in any circumstances, nor for the consequences of the decision taken on that basis.
Use of the Platform is at Your sole risk and the cost associated with your connection to the Platform as well as your access to the Products. Robert Brzoza-Birch Group does not warrant unrestricted and uninterrupted access to Platform resources and that the result of the search and the information obtained will meet the expectations of the User as to their content and usefulness.
§ 13

Robert Brzoza-Birch Group reserves the right to unilaterally decide on the contents of the Platform, to make changes and modifications, to suspend or withdraw a particular Platform item.
Robert Brzoza-Birch Group will be entitled to discontinue access to the Platform without giving any reason after the completion of all courses taking place or no earlier than 60 days after the last course of the course and after prior notification to the registered Users.
All products sold by Robert Birch-Birch Group and Contractors are subject to a 30-day satisfaction guarantee or a money back guarantee beyond the guarantee of the law. The warranty period is from the date of payment. Robert Brzoza-Birch Group and Contractors will only accept refund requests addressed directly to the email address or through the "Contact" tab. E-mails that have not been confirmed within 3 days are considered unsatisfactory. The return will be made within 14 days provided that Robert Brzoza-Birch Group and Data Partners receive the transfer to a Polish bank or via the online payment system used to pay the order, as long as technically possible.

1. Notwithstanding the above, and irrespective of the Organizer in accordance with the law, the Customer has 14 days to return the goods (physical goods) or to cancel the service (non-physical services and products) and receive the refund within 14 days of the refund. This right does not apply if the service is performed within 14 days of the date of its payment with the consent of the User.
   Products sold by the Organizers / Kotlers eNetes are subject to a return policy specified each time in the offer or order form of the product. The complaint is a phone number / E-mail address of the Organizer, which must be published on his / her profile, on the order form of each of his / her Products, within the Platform Product and in the confirmation email for the Product. An additional form of contact is the private message system provided by the Platform. In case of problems, you may also ask for assistance in contacting the Platform Operator: office@enetes.com
   If the Organizer agrees, or in response to a request for a refund, it will not indicate the way to resolve the dispute, the Consumer may use the online dispute resolution platform.
   § 14

   Information, advice, expert answers or any other information contained on the Platform are not the official positions of Robert Brzoza-Birch group unless otherwise indicated.

   § 15

   Robert Brzoza-Birch Group is not responsible for the information, opinions, comments distributed by users on the Platforms and for damages resulting from events are beyond the control of Robert Brzoza-Birch Group, in particular, the violation of the rights of third parties as well as the rules of general binding.
   Robert Brzoza-Birch Group is not responsible for any consequences resulting from the User's disclosure to third parties of the password and login regardless of the reason for the disclosure.

   § 16

1. You are solely responsible for the content provided through the Platform of Your Information.
   The contractor is responsible for the full legal and financial responsibility for the content and must be owned by the copyright owner. Sharing of copyrighted third-party resources must be done only with their written consent.
   § 17

   All names and trademarks or trade names on the Platform are protected.
   Unless otherwise stated, the Platform and its content are protected by copyright and related rights. Copying and distribution beyond personal use may take place only after the prior written consent of Robert Brzoza-Birch Group or its owner, and only in the indicated range.
   VI. Personal data protection

   § 18

   Submission to Robert Brzoza-Birch Group through the Registration Application Platform is equivalent to giving you consent to the processing of data contained therein, including processing for marketing purposes.
   Collected personal data is administered by Robert Brzoza-Birch Group / Partner or by the entity acting on behalf of Robert Brzoza-Birch Group and may be made available to entities authorized by law that generally apply, inter alia, the transfer of personal data from one type of medium to another.
   The submitted data can be used for information and promotional purposes Robert Brzoza-Birch Group.
   Submitting to Robert Brzoza-Birch Group / Partner via the Product Or Service Platform is the same as granting the User the right to provide the Organizer and Trainer with this Product or User Data (including personal data) contained in the Order for the purpose of performance of the order and for marketing. Robert Brzoza-Birch Group is not responsible for the processing of this data by the Organizer and Coaches other than Robert Birch-Birch Group.

   §19

   Personal data included in the Registration Form is processed to the extent necessary in accordance with the law.
   You have the right to inspect the data relating to it and to correct it and remove it.

   VII. Technical disclaimers

   § 20

   Robert Brzoza-Birch Group does not warrant that the information sent via the Internet will reach the user in the error-free, complete and complete form.
   Robert Birch-Birch Group is not liable for damages caused by malfunction of the transmission system, including equipment failures, delays, and interruptions.
   If required for safety reasons or other, independent of Robert Brzoza-Birch Group, he or she can temporarily limit access to the Platform for a period of time that requires removal of the reasons for lack of access. In that case, Robert Brzoza-Birch Group is not responsible for any limitations in the availability of the Platform.
   VIII. Final Provisions

   § 21

   Registered Platform Users agree to the transmission of information and messages by email and using digital telephony and acknowledge them as effectively delivered.

§ 22

1. Any changes to the Terms and Conditions introduced by Robert Brzoza-Birch Group will be posted on the Platform.
   Changes to the Terms and Conditions are binding after 14 days for registered users and from the time they are posted to the Platform for other users.
   § 23

   Your rights and obligations are not transferable to a third party without the prior written consent of Robert Brzoza-Birch Group.

   § 24

   The regulations will be interpreted in accordance with generally accepted Polish law.

   § 25

   Any disputes with Robert Brzoza-Birch Group arising in connection with the functioning of the Platform will be settled by the General Court proper for the seat of Robert Brzoza-Birch Group.
   Disputes between the users and the course organizers will be settled by the General Court for the seat of the training company/contractor.
   § 26

   Robert Brzoza-Birch Group may conclude separate contracts with the Training Companies and Trainers, whose provisions are overridden by these Rules.
